1. Introduction
Welcome to ChurchPlace ("Service"), a church management platform operated by Daniel Kuśmider, operating as a sole proprietorship registered in Poland under tax identification number NIP: 7922234750 ("Company", "we", "us", or "our").
By using our Service, you agree to the terms of these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use the Service.
2. Service Description
ChurchPlace is a Software-as-a-Service (SaaS) platform designed to help churches and religious organizations manage:
- Member profiles and directory
- Event scheduling and volunteer coordination
- Ministry team management
- Communications and notifications
- Forms and surveys
- Service planning (songs and playlists)
- Event synchronization with external calendars, including Google Calendar (via Google Calendar API integration)
3. Eligibility and Account Registration
3.1 Age Requirements
To create an account, you must be at least 16 years old. You are required to provide your date of birth during registration for age verification purposes.
If you are between 16 and 18 years old, parental or legal guardian consent is required. In such cases, the system will request a parent/guardian email address, to which a consent confirmation will be sent. The account will be fully activated upon obtaining this consent.
Persons under 16 years of age may not independently create an account on the Service.
The Google Calendar integration is available only to users who are 18 years of age or older.
3.2 Account Creation
By creating an account, you agree to:
- Provide accurate, current, and complete information, including your true date of birth
- Maintain and update your information as needed
- Protect your password and keep it confidential
- Immediately notify us of any unauthorized access to your account
- Accept responsibility for all activities on your account
Providing a false date of birth to circumvent age requirements constitutes a violation of these Terms and may result in account suspension or deletion.
3.3 Church Organization Accounts
If you create a church organization on ChurchPlace, you represent that:
- You are authorized to act on behalf of the church
- The church consents to the processing of its members' data in accordance with our Privacy Policy
4. Acceptable Use
4.1 You agree to:
- Use the Service only for lawful purposes
- Respect the privacy and data of other users
- Comply with all applicable laws and regulations
- Use the Service solely for church and religious organization activities
- Comply with the terms of use of third-party services to which you connect your account (including Google's Terms of Service) when using integrations available in the Service
4.2 You may not:
- Share your login credentials with others
- Attempt to gain unauthorized access to the Service or its systems
- Upload malicious code, viruses, or harmful content
- Use the Service to harass, discriminate against, or harm others
- Collect personal data of other users without authorization
- Use the Service for commercial purposes unrelated to church activities
- Violate applicable data protection regulations
- Share, sell, or otherwise transfer authentication tokens (including OAuth tokens) granted by third-party services through ChurchPlace
- Use third-party service integrations (including Google Calendar) in a manner that violates the terms of use of those services
5. User Content
5.1 Your Content
You retain ownership of content you upload to the Service. By uploading content, you grant us a limited license to store, display, and process it to the extent necessary to provide the Service.
5.2 Third-Party Service Data
Data synchronized from third-party services (such as Google Calendar) remains your property and is subject to both these Terms and the terms of use of the respective third-party service. In particular, data received from Google APIs is subject to the Google API Services User Data Policy, including the Limited Use Requirements.
5.3 Prohibited Content
You may not upload content that:
- Infringes intellectual property rights
- Contains personal data of individuals without their consent
- Is defamatory, hateful, or discriminatory
- Violates applicable laws
6. Third-Party Service Integrations
6.1 Google Calendar
ChurchPlace offers an optional integration with Google Calendar via the Google Calendar API. This integration:
- Requires your explicit consent via the OAuth 2.0 authentication process
- Enables synchronization of church events with your Google Calendar
- Enables display of your availability (free/busy) to facilitate ministry scheduling
- May be disconnected at any time via your ChurchPlace account settings or via your Google Account permissions page (https://myaccount.google.com/permissions (opens in new tab))
6.2 Third-Party Service Terms
By using third-party service integrations, you acknowledge and agree that:
- Use of Google services is subject to Google's Terms of Service (https://policies.google.com/terms (opens in new tab)) and Google's Privacy Policy (https://policies.google.com/privacy (opens in new tab))
- ChurchPlace is not affiliated with, sponsored by, or endorsed by Google LLC
- ChurchPlace is not responsible for the availability, operation, or changes to third-party services
- In the event of a conflict between these Terms and the terms of a third-party service with respect to data from that service, the third-party service terms shall prevail
6.3 Disconnecting Integrations
Upon disconnecting the Google Calendar integration:
- Data synchronization will stop immediately
- OAuth authentication tokens will be revoked
- Calendar sync data will be deleted within 30 days
- Events created in ChurchPlace and synchronized to your Google Calendar will remain in your Google Calendar — their removal requires action on your part directly in Google Calendar
6.4 Google API Compliance
ChurchPlace's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy (opens in new tab), including the Limited Use requirements. Specifically:
- We use Google Calendar data solely to provide and improve user-facing features visible in the ChurchPlace interface
- We do not use or transfer Google data for serving ads
- We do not use Google data to train artificial intelligence or machine learning models
- We do not allow humans to read Google user data except in the circumstances described in our Privacy Policy

7. Intellectual Property
7.1 Our Rights
The Service, including its software, design, logo, and documentation, is owned by or licensed to the Company. You may not copy, modify, distribute, or create derivative works without our written consent.
7.2 Feedback
If you provide feedback or suggestions regarding the Service, we may use them without any obligation to you.
8. Right of Withdrawal
8.1 Consumer Right
If you are a consumer under Polish and EU law, you have the right to withdraw from the contract within 14 days of its conclusion without giving any reason.
8.2 Exercising the Right of Withdrawal
To exercise your right of withdrawal, you must inform us of your decision by means of an unequivocal statement (e.g., a letter sent by post or email to the address provided in Section 16).
8.3 Effects of Withdrawal
In the event of withdrawal, we will refund all payments received no later than 14 days from the date we received your withdrawal statement, using the same payment method you used.
8.4 Exception — Immediate Commencement of Service
If you request that the Service commence before the withdrawal period expires, you must give your explicit consent. In such a case, if you withdraw from the contract after you have started using the Service, you will pay an amount proportional to the scope of services provided up to the point at which you informed us of your withdrawal. If the Service has been fully performed, the right of withdrawal does not apply.
9. Service Availability
9.1 No Guarantee
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled maintenance (of which we will inform you with at least 48 hours' notice)
- Technical issues
- Circumstances beyond our control
9.2 Third-Party Services
The availability of features dependent on third-party services (such as the Google Calendar integration) is contingent on the availability of those services. We are not responsible for interruptions, changes, or discontinuation of third-party services.
9.3 Modifications
We may modify, suspend, or discontinue any aspect of the Service. We will provide 30 days' notice of material changes. We will provide 90 days' notice of discontinuation of the entire Service.
10. Fees and Payments
10.1 Free and Paid Plans
The Service offers free and paid subscription plans. Current pricing is available at https://churchplace.io/pricing (opens in new tab).
10.2 Billing Period
Subscriptions are billed on a monthly or annual basis, depending on the plan chosen. Payment is charged in advance at the beginning of each billing period.
10.3 Price Changes
We may change prices with 30 days' notice. New prices will take effect from the next billing period. Continued use after the start of a new billing period constitutes acceptance of the new prices.
10.4 Refunds for Early Termination
In the event of termination of a paid subscription before the end of the paid period:
- For monthly subscriptions: no refund is provided
- For annual subscriptions: a prorated refund for unused full months is provided, reduced by any discounts resulting from the annual plan selection
11. Termination
11.1 By You
You may terminate your account at any time through the Service settings or by contacting us. Termination takes effect at the end of the current billing period.
11.2 By Us
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Fail to pay due fees within 14 days of a payment reminder
Before terminating an account for a Terms violation (except for serious violations), we will inform you of the violation and give you 7 days to remedy it.
11.3 Effects of Termination
Upon termination:
- Your access to the Service will end
- All third-party service integrations (including Google Calendar) will be disconnected and OAuth tokens revoked
- Your data will be retained for 30 days, during which you may request data export. After this period, data will be permanently deleted unless the law requires longer retention
- Data synchronized from Google Calendar will be deleted within 30 days of account termination
- Provisions that should survive termination (in particular Sections 5, 6, 7, 12, 13, and 14) remain in effect
12. Limitation of Liability
12.1 Disclaimer
THE SERVICE IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
12.2 Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Loss of data, profits, or business opportunities
- Damages exceeding the fees paid by you in the 12 months preceding the claim
- Damages arising from the operation, non-operation, or changes in third-party services (including Google Calendar)
12.3 Exceptions
The above limitations do not apply to:
- Damages caused intentionally or through gross negligence
- Liability that cannot be excluded under mandatory provisions of law
- Consumer rights under Polish and EU law
13. Indemnification
You agree to indemnify and hold the Company harmless from any claims, damages, or expenses arising from:
- Your use of the Service in violation of these Terms
- Your violation of these Terms
- Your violation of the rights of third parties
- Your violation of the terms of use of third-party services (including Google's Terms of Service) while using integrations available in ChurchPlace
The above obligation does not apply if the violation was not caused by your fault.
14. Dispute Resolution
14.1 Governing Law
These Terms are governed by Polish law.
14.2 Amicable Dispute Resolution
In the event of a dispute, we encourage you to contact us to resolve the matter amicably. Consumers may also use the European Commission's Online Dispute Resolution (ODR) platform available at https://ec.europa.eu/consumers/odr (opens in new tab).
14.3 Jurisdiction
Any disputes that cannot be resolved amicably shall be settled by Polish courts. Consumers may also assert their rights before a court having jurisdiction over their place of residence, in accordance with EU law.
15. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes with 14 days' notice via:
- Email to your registered address
- A notification within the Service
If you do not agree to the changes, you may terminate the contract before the changes take effect. Continued use of the Service after the changes take effect constitutes acceptance.

17. Severability
If any provision of these Terms is found to be unenforceable by a competent court, the remaining provisions shall remain in full force and effect. The unenforceable provision shall be replaced by a provision that most closely reflects the original intent of the parties.
18. Entire Agreement
These Terms, together with the Privacy Policy, the Google API Services User Data Policy (to the extent applicable to Google data), and any additional terms for specific features, constitute the entire agreement between you and the Company regarding the use of the Service.
